Obama's Court Gambit

The Obama administration's announcement that 9/11 mastermind Khalid Sheikh Mohammed will be tried in a New York traffic court, has conservatives screaming that he will go free. He won't go free. Here's the game.

Liberal activists want the prosecution of our effort against Islamism treated as criminal activity not as a military operation. A "successful" trial of Mohammed, resulting in his permanent incarceration (liberals and Islamist pacifiers won't allow him to be executed) will give them fodder to say that they got a good result.

What this does is one, begin to disengage the military; two, elevate the role of courts (a subtle point but one that shouldn't be missed) and 3, extend rights to jihadists that exceed those of citizens.

No, he won't go free.

It will give him/his cohorts an international stage from which to spew their venomous propaganda, from the scene of the assault, no less. Thus, the American people will have wounds re-opened, salt poured in, & ground with these men's heels. Nice, BHusseinO.

I have to ask, though, is their thirst for 'revenge' against the Bush Admin. so unquenchable that they must crush our own people like this?? That they must set such dangerous legal precedent (for future operations, as you suggest)? It's just inconceivable to me that they're doing this.

I hadn't thought about the elevation of courts' role. Interesting...

My answer to your question is that Obama and his administration have contempt for your concept of America and anyone who shares your view of what and who we are; that extends far beyond Bush. Just so you don't misunderstand, he is an authoritarian statist who is better than you and me.

They will put the CIA and the Bush administration, particularly Cheney on trial, this has nothing to do with justice for KSM.

I'm seeing that now. Thanks for the clarity. Yet, is it so important to exact political revenge (upon someone who's not even a rival), that one would endanger the security of our nation in order to achieve it? It really makes me think that there's a larger hand at work here, but who?

Hey CB, guess what! Ducky's here & he wants us to believe that the piece of human dirt called KSM actually BELONGS in our Civil Justice system! Ha! And he's trying to construe my displeasure (& yours) as somehow anti-patriotic, as if we don't have faith in our own legal system.

Duck~ You're obscuring the point, of course. The fact is that KSM, et. al. are not street criminals to be tried in civilian court. They are terrorist WAR criminals, belonging under military jurisdiction alone.

Oh! Gotta run...I think I hear thumping propellers overhead...Whew! Good thing I don't eat Corn Flakes!

Well Susannah, there certainly was a big hesitancy under Bush to try anyone in a military or civilian court.

Indefinite detention and now that has to be resolved.

Why try him in civil court? Was the first world trade center bombing an act of war? These are moot points and decisions get made. I hope this isn't being made for political purposes and I don't see what Obama would expect to gain but I have confidence in the courts.

Picking military vs. civilian is just picking sides. None of us posting here have the legal or Constitutional qualifications to make a determination. That is why I often reply to right wingers with sarcasm. They have a habit of not knowing what the don't know.
